1. GENERAL PROVISIONS

 

By placing a binding order, the buyer confirms that he accepts the Terms and Conditions for the delivery of goods announced by the seller. The relations between the buyer and the seller are governed by these terms and conditions, which are also binding for both parties.

2. ORDERING GOODS AND SERVICES

 

We offer you the option of ordering products, where each piece is original and unique due to the nature of artistic hand-made production. You can order simply by creating and sending a request, conveniently using the "Request" button, by phone, e-mail, or in writing at our address.

Based on the created and sent Request, we will contact you to provide detailed information regarding your shipment, i.e. the time and method of delivery, the amount of packaging and postage, and the total price and method of payment for the order. A binding order will only be sent to you based on mutual confirmation. 

The delivery time of a product that is not in stock here in the Czech Republic or at a supplier abroad is always subject to inquiry, due to the total manual processing of each product and thus its uniqueness. Please note that since each product is original, it is not possible to guarantee that two types of the same type of product will be identical. In this case, a deposit of 50% is paid in advance, before the start of production itself. The remaining 50% is paid before handing over the goods to the carrier.

 

The subject of the contract is only the goods listed in the binding order. Dimensions, weight, performance, capacity and other data listed on our website, in catalogues, brochures and other printed materials are non-binding data and based on the manufacturers' data. In case of discrepancies, we will of course contact you.

Sending an Inquiry does not create an obligation for the interested party to purchase the goods.  The request is completely non-binding and intended for mutual communication and subsequent creation of a personalized binding order. In individual, especially more expensive cases, the contract is formed by confirmation of the order by email, in person or by phone and payment of a financial advance or the entire purchase price by the buyer. Each order, delivery time and final price are always agreed with the customer in the form of a price quote, before the customer sends the order.

 

In the event that during the time when the goods were ordered, there was a significant change in the foreign currency exchange rate or a change in the price or the supplied assortment by the supplier, our company has the right to modify the order in agreement with the buyer or withdraw from it unilaterally with immediate effect. We reserve the same right even if the manufacturer stops supplying the ordered product or launches a new version of the product or significantly changes the price of the product. Product prices are valid while supplies last.

 

3. ORDER CONFIRMATION

 

We send order confirmation by e-mail. We will always contact you in case of misunderstandings.

For goods that are in stock in the Czech Republic or at the supplier, we always require full payment in advance. The goods are sent to the customer only after the full purchase price has been paid.

For goods that are not in stock and must be manufactured, payment of the purchase price is in the form of an advance payment of 50% of the total price of the goods in advance, and the remaining 50% of the purchase price is paid after production, before the actual shipment of the product to the customer's address. The goods will be sent only after the full purchase price has been paid. 

 

4. CANCELLATION OF ORDER

 

You can cancel any order within 24 hours by phone or e-mail without giving a reason. All you have to do is enter your name, e-mail address and a description of the ordered goods or services.

Withdrawal from the contract is not possible in cases of goods that were made to order for the client. In such a case, the deposit paid by the client for the production of the goods is forfeited in full to the costs of production and the efforts associated with it. The customer is always informed of this fact in advance by us in the offer with a reference to these Terms and Conditions.

In connection with the exercise of the right to withdraw from the purchase contract in cases where the goods were in stock, the buyer is obliged to return the unused goods to the seller undamaged, packed and protected against damage during transport in the same way as it was during delivery. The seller is not obliged to accept goods that are damaged, incomplete (this also applies to packaging) or in a condition that makes their further sale impossible or difficult, and the effects of withdrawal from the contract do not apply. The buyer is not entitled to send the returned goods back to the seller on cash on delivery, the costs of returning the goods are borne by the buyer.

 

In the event of a valid withdrawal from the contract, the seller will return the paid purchase price of the goods to the buyer in the shortest possible time, but no later than 30 days. The seller does not refund the amount for postage. If postage was not charged for the returned product or products upon delivery, the seller has the right to additional payment. In this case, the seller will return to the buyer the amount reduced by these costs.

 

5. PACKAGING AND POSTAGE

Shipping costs are charged separately to the customer and vary according to the weight, volume and value of the goods. We will send the ordered goods to you by a transport company or the transport can be carried out directly by the customer: in this case, as soon as the goods are packed, we will tell you the dimensions and weights of the pallets. 

After ordering, we will send you the best possible offer, including shipping costs, packaging costs and any other possible charges.

The prices of individual services of individual carriers are based on their current offer.

6. DELIVERY TIME

The delivery time is usually 48 hours and it is the time from the receipt of payment to the dispatch of the goods, while this time only applies to goods that are in stock in the Czech Republic.

 

For goods that are in stock at the supplier, the delivery time is usually 7-14 days, but we will always inform you of the exact delivery time in advance.

 

For products that are not in stock either in the Czech Republic or at the supplier, the delivery time is different, on the order of 6 weeks or more. The approximate delivery time is always communicated to the customer in advance.

 

7. EXCHANGE OF GOODS

Due to the originality and uniqueness of the goods, it is not possible to exchange the goods. Inform us by phone or email. 

8. CLAIMS AND WARRANTY

We will handle any complaints to your satisfaction by an individual agreement with you and in accordance with the applicable legal regulations. The buyer is obliged to inspect the goods after receiving them in order to detect any defects and damage, especially damage to the packaging during the delivery of the goods. The buyer is obliged to report any defects to our company immediately. We are not responsible for defects caused by the carrier. If you find visible damage to the shipment, do not accept the goods at all, we recommend taking photos. CAUTION! - Warranty appliesonly for manufacturing defects that prevent the normal use of the product.The change in the appearance of the material in terracotta from Impruneta is not a defect of the product but its typical feature. In the case of other products, due to the nature of hand-made production, their imperfections and irregularities are also typical, which the customer takes note of and which cannot be claimed.

 

WARRANTY DOES NOT COVER:

  • defects caused by normal use

  • improper use of the product

  • improper storage

 

COMPLAINT PROCEDURE:

  • inform us about the complaint by phone, e-mail or in writing

  • send the goods as a registered package (not cash on delivery) to our address

  • state the reason for the complaint and your address in the shipment

  • proof of purchase of the claimed goods in our store

 

The price of a phone call according to your operator's tariff. We will handle your complaint as quickly as possible, no later than within 30 days of its origin, i.e. the receipt of the goods by our company.

 

9. PROTECTION OF PERSONAL DATA:

The protection of personal data of the buyer, who is a natural person, is provided by Act No. 110/2019 Coll., on the processing of personal data, as amended.

 

With his purchase, the buyer acknowledges that for the purposes of realization of the rights and obligations from the purchase contract and for the purposes of maintaining the user account, we will process his data in the scope of: name and surname, residential address, identification number, tax identification number, e-mail address , telephone number (hereafter all together only as "personal data"). Personal data in the scope of name, surname, address, email and telephone will be provided to the manufacturer for the purpose of delivering the goods to the customer's address.

 

If the buyer does not choose another option, he agrees to the processing of personal data by the seller also for the purpose of sending information and commercial messages to the buyer.

The buyer acknowledges that he is obliged to provide his personal data correctly and truthfully (when registering, in his user account, when ordering from the store's web interface) and that he is obliged to inform the seller without undue delay of a change in his personal data.

 

The seller can entrust the processing of the buyer's personal data to a third party as a processor. Apart from the persons transporting the goods, personal data will not be transferred by the seller to third parties without the prior consent of the buyer.

 

Personal data will be processed for five years from the last purchase, or until the buyer's appeal. Personal data will be processed in electronic form or in printed form.

 

The buyer confirms that the personal data provided is accurate and that he has been informed that this is a voluntary provision of personal data.

 

The buyer, as a subject of personal data, has the right to:

ask the seller or processor for information about what data we process and to what extent 

request that the seller delete his personal data

 

9. SENDING COMMERCIAL MESSAGES AND STORING COOKIES:

The buyer agrees to send information related to the seller's goods, services or business to the buyer's e-mail address and further agrees to the seller's sending commercial messages to the buyer's e-mail address.

 

The buyer agrees to the storage of so-called cookies on his computer. In the event that it is possible to make a purchase on the website and to fulfill the seller's obligations from the purchase contract without so-called cookies being stored on the buyer's computer, the buyer can revoke the consent according to the previous sentence at any time.
